La provincia tiene una honda tradición en el constitucionalismo español desde 1812, y
también en la vigente Constitución de 1978, en la que, pese a los debates habidos en el
periodo constituyente, los artículos 137 y 141 establecieron una regulación que garantizaba
su mantenimiento. Y la interpretación del Tribunal Constitucional sobre dichos artículos
ha supuesto una gran rigidez en el mantenimiento de la provincia. De suerte que su abolición
implicaría la necesidad de una reforma constitucional. No obstante, por muy diversas
razones son varias las posiciones académicas y políticas que defienden su abolición o su
profunda reforma. Sin embargo, se considera que pese a los muchos puntos débiles que
tiene la regulación actual de la provincia como entidad local, este tema no puede abordarse
con carácter general que imponga una única solución en todo el Estado español,
porque los sentimientos respecto a lo que representa la provincia son muy distintos en
cada Comunidad Autónoma. Por otra parte, en los casos en que los Estatutos de Autonomía
han creado otros entes locales supramunicipales, la superposición de competencias
en este escalón administrativo es claramente disfuncional en términos de eficacia administrativa.
Y en todo caso, el tema no debe tratarse al margen de una posible reforma del
régimen local de gran envergadura, especialmente de la supresión de los pequeños municipios
que son entes administrativos incompatibles en términos de eficacia con el mundo
actual. |

The Province has a deep tradition in Spanish constitutionalism since 1812, which has
remained in force in the Constitution of 1978. In spite of the discussions in the constitutional
period, articles 137 and 141 established a regulation that guaranteed its maintenance.
In addition, the interpretation of the Constitutional Court on those articles has entailed
a great rigidity, favouring the maintenance of Province, so that its abolition would imply
the need for constitutional reform. Nevertheless, for various reasons, there are a number
of political and academic positions that defend its abolition or its reform. However, it is
considered that in spite of the many weaknesses of the current regulation of Province,
such as local entity, this topic cannot be dealt with as a general rule that imposes a single
solution in the whole Spanish State, because of different feelings regarding what represents
Province in each Autonomous Community. On the other hand, in cases where the
Statutes of Autonomy have created other supra-municipal bodies, the overlap of powers
on this level is clearly dysfunctional in terms of administrative efficiency. In any case, the
issue should not be treated apart from a possible reform of the local regime of large -
scale, especially in the case of the elimination of small municipalities that are incompatible
with the effectiveness that is required for today’s world. |
